Paths To Permanent Residency

Most visas do not serve as a path to permanent residency, and the E-2 is no exception in this regard. What is different about it is that it's almost equivalent to permanent residence.

If you want to stay long term in the United States, an E2 Visa makes that possible. All you need to do is keep running your business and renew your visa as necessary. You need to be mindful of what may happen when you want to end the business or retire, however. These sorts of issues regarding future planning for foreign entrepreneurs should be discussed or mapped out with an attorney early on since the options for how you go about navigating this can differ for each person or family. For example, many people come to the United States on an E-2 visa and have a child who is a citizen by virtue of being born in the country. Once the child reaches 21 years of age, they can petition for their parent's permanent residency.

Another possibility is to get permanent residency via an EB-2 National Interest Waiver. This is a fine approach to take if you so wish, but at the end of the day, please be aware that an E-2 in and of itself does not give you a pathway to permanent residency.
